1. About Us

SceneSend ("SceneSend", "we", "us", "our") is a temporary file transfer platform operated by Castingcrowd Ltd, a company registered in England and Wales.

SceneSend is a trading name of Castingcrowd Ltd.

2. Acceptance of These Terms

By creating an account, uploading content, accessing content via a 5-digit code, or otherwise using the Service, you agree to be legally bound by these Terms & Conditions ("Terms").

If you do not agree, you must not use the Service.

3. Definitions

  • "Service" – The SceneSend file transfer platform.
  • "Registered User" – A person who creates an account to upload Content.
  • "Recipient" – A person who accesses or downloads Content using a 5-digit access code without creating an account.
  • "User" – Any Registered User or Recipient.
  • "Content" – Any files, documents, images, scripts, production materials, or other data uploaded to the Service.

4. Nature of the Service

SceneSend provides temporary file hosting and transfer.

  • Registered Users must create an account to upload Content.
  • Recipients may download Content using a 5-digit access code without registering.
  • Files are automatically deleted after 1 hour, 24 hours, or 48 hours, as selected by the Registered User.
  • The Service is not intended for permanent storage or archival purposes.

5. Registered User Accounts

To upload Content, you must create an account and provide:

  • First name
  • Last name
  • Email address
  • Password

You agree to:

  • Provide accurate information
  • Keep login credentials secure
  • Be responsible for all activity under your account
  • Notify us of unauthorised access

We may suspend or terminate accounts if these Terms are breached.

6. Access by Code (Recipients)

Recipients may access Content using a 5-digit access code without creating an account.

By accessing or downloading Content, Recipients agree to be bound by these Terms.

Recipients must not:

  • Share access codes unlawfully
  • Redistribute Content without authorisation
  • Use Content in breach of copyright or confidentiality obligations

SceneSend is not responsible for how Content is used once downloaded.

7. User Responsibilities & Prohibited Use

Users must not:

  • Upload Content they do not have the legal right to share
  • Upload Content that infringes copyright, confidentiality, or privacy rights
  • Upload unlawful, defamatory, or harmful material
  • Upload malware or malicious code
  • Use the Service for fraudulent or illegal purposes
  • Attempt to interfere with or reverse engineer the Service

Registered Users are solely responsible for Content uploaded under their account.

8. Intellectual Property

Registered Users retain ownership of their Content.

By uploading Content, you grant Castingcrowd Ltd a limited, non-exclusive, royalty-free licence to:

  • Store the Content temporarily
  • Transmit the Content to Recipients
  • Perform technical processing necessary to operate the Service

This licence automatically terminates upon deletion of the Content.

Castingcrowd Ltd does not claim ownership of User Content.

9. File Expiration & Deletion

Files are automatically deleted from active systems after the selected expiration period.

Users acknowledge:

  • Deletion is automatic and irreversible
  • We do not guarantee recovery of expired files
  • Residual encrypted backups may persist temporarily for security and system integrity but are not accessible and are routinely purged

SceneSend is not liable for loss of Content due to expiration.

10. Confidentiality & Security

We implement reasonable technical and organisational security measures.

However:

  • Absolute security cannot be guaranteed
  • Access is controlled solely via access codes
  • We do not verify the identity of Recipients

Users are responsible for assessing whether the Service is appropriate for confidential production materials.

11. Data Protection & Privacy

We process personal data in accordance with UK GDPR and the Data Protection Act 2018.

Personal data collected includes:

  • First name, last name, email, and encrypted password (Registered Users)
  • IP address and device information (all Users)
  • Payment data via Stripe
  • Content uploaded by Registered Users

Our hosting infrastructure is located in the United States. Where personal data is transferred outside the UK, we rely on appropriate safeguards, including Standard Contractual Clauses and the UK International Data Transfer Addendum.

12. Payments

Where paid features or credits are offered:

  • Payments are processed securely by Stripe
  • We do not store full payment card details
  • Credits are non-refundable except where required by law
  • Credits have no cash value

13. Indemnity

You agree to indemnify and hold harmless Castingcrowd Ltd, its directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

  • Your Content
  • Your use of the Service
  • Your breach of these Terms
  • Infringement of third-party rights

14. Limitation of Liability

To the fullest extent permitted by law, Castingcrowd Ltd shall not be liable for:

  • Loss of data or files
  • Business interruption
  • Loss of profits
  • Unauthorised access
  • Misuse of access codes
  • Indirect or consequential loss

Nothing in these Terms excludes liability for death, personal injury, fraud, or any liability that cannot lawfully be excluded.

15. Suspension & Termination

We may suspend or restrict access, remove Content, block access codes, or terminate accounts if:

  • These Terms are breached
  • The Service is misused
  • Unlawful activity is suspected

16. Changes to These Terms

We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction.
